I'm not sure about Texas law, but in Mississippi, if your wife is pregnant during the divorce, the child is considered yours. Go have a paternity test and take the paperwork with you to prove it isn't your child. You should not be responsible for a child that isn't yours.Advice on divorce?
Since you are not the father then i would say without children. But i would seek the advice of a lawyer in any divorce case.
