kidsWhat is the process of changing my will in a divorce. Any advice ? We have kids, Do I just leave everything to?
If you are worried your ex might have grounds to contest the will, consider leaving him a very specific, very small bequest, like $20. That way there is no chance for claiming that he was overlooked.
Of course, consult with your attorney or representative. What is the process of changing my will in a divorce. Any advice ? We have kids, Do I just leave everything to?
yeah, just dont forget to name the executor of your estate in your will. one of your children usually or an elder (such as a brother/sister) if your kids are minors upon your death. if youre not married to their mother, even if you dont change her name in the will, she's not your spouse any longer and has no rights to your estate unless she has her name on any property such as a house, land, or other assets. those can be changed in a living trust.
This is one you really need to talk to your attorney about. I had to do this also. I left things to my sons, and had my eldest as an executor with my parents as co-executors with him. Also consider your living will also. Don't want the EX to get a hold of you during a health emergency. Do a durable power of attorney also, aka, Living will...
It's your Will and you can leave your estate to whomever you desire.
