Divorce advice?

Friends are breaking up. He has total control of their finances and he's cheating on her. She wants to ask for divorce but just discovered that he's closed out all of their accounts. She cannot access any money and the lawyer is demanding a $5,000 retainer up front.





Should she look for another lawyer, one who will work with her? Is this normal behavior for lawyers? Husband is screwing her over and now she can't pay for divorce.

New York is the ONLY state without a no-fault divorce option. If your friend has a credit card, or access to the credit card account number, that might be one option to pay for the attorney.

absolutly 5000 is way too much for a lawer to ask for especialy just upfront money he must have that one in his pocket i think youu should be able to get the whole thing done for under 1000 if it is uncontested but she may want to move out and wait he may pay for it if he dicides he wants it finalized befor her no big deal i would play the waiting game you simplely wait till they dicide they want the divorce bad enough to pay for it themselves then when you get the papers look at them and dicide if the terms are ok with you if not get a lawer and fight on key issues good luck

there are no children involved She can get a divorce for 150.00 dollars.And she can have them ask that she be granted


exactly half of the properties owned during the marriage between both parties.
She needs to start looking for a different lawyer. There are usually ones that will work with you knowing that they may not get their fee until the divorce is settled. In fact if a lawyer won't help her, she should ask them if they could recomend one who might be willing to handle her case.
Hmm, you have'nt mentioned Which part of the world is this incident happening?? Coz The legal assisstence differs from State to state (in case of USA) and province to province(incase of CANADA).But since i reside in Canada(ontario).Most of the Canadian provinces offer free legal assisstence through community centres and Neighbourhood services.or perhaps Womens NGO's listed in Telephone directory (YELLOW PAGES).





BUT I THINK SHE MUST ACT FAST BEFORE HER HUSBAND ESCAPES WITH HER BOOTY TO SOME UNKNOWN PLACE.
Well i would look for another lawyer probuno means free or they dont get paid until you do. I would not let this stop her from getting a divorce! Most lawyers can be very twisted GOOD LUCK!!!
I'd get a different attorney, one who will help her reopen an account. He can't take her off of a bank account or close it without her signature as well. So she's still entitled to that money. You need to get a hold of the bank, figure out exactly what went on, when it took place, and what can be done to help her out financially since he legally couldn't close the account on his own. He's withholding property, which whenmarried, is illegal.
It is normal for an attorney to ask for some money up front, however I think if he demands 5 thousand, you should find a different lawyer. An attourney that knows he will be able to win a good amount of money, should only ask for a percentage of the fee up front, since he is confident he will win for you that is.

My lawyer charged $900 up front and that covered everything. Of course, I got what I paid for. I had to practically represent myself in court because he didn't say anything at all. He just stood there. But at least I didn't have to file any paper work.
