I need some advice. I need to know how to get a divorce from my ex without him. B/c he will not send the papers back.Divorce Advice?
It all depends on where you live. Do you have a lawyer? If you do, call her and ask for her help. There are ways of pushing it through the court without him there. If you don't have a lawyer call the courthouse or the DA's office and ask. I'm sure there are people there who are able to help.
I know that in Alabama you can divorce someone without them even knowing. It happened to several people that we knew. But like I said, just call and explain what your situation is and ask for some advice.Divorce Advice?
Just contact a lawyer and file the papers. He will be served and then has 28 days (it will vary in each state) to respond. If he does not respond, then he will be in default. As far as I know, he doesn't need to respond in order for the divorce to happen. If he does not respond or hire an attorney, then you pretty much will get what you want with the divorce.
If your husband (untill finalized) does not send the papers back in, that works in your favor. Different states vary by the amount of days required to wait.
The judge will grant you divorce and basically everything will go to you. No response from him means he's not disputing the divorce.
To take the issue to court and have him subpoenaed. That way if he does not show up in court then he will be picked up. That will give you some leverage to have him sign the documents. Tell him that it is over and you and he must move on with your lives.
talk to your lawyer (if you go to court i think the judge can just rule for the divorce -since he never returned the papers)
i'm willin to bet he's told you he won't give you a divorce (BullSh*t) my soon to be ex tried the same thing..it will not matter if he sends the papers back,,there is no law no judge no body that can MAKE you stay married period. go see a lawyer a.s.a.p.!!speakin from experience ..get a female lawyer.
I know that in the state of kansas that it takes 90 days for the divorce to be final without both partys consent if the husdband doesnt consent then in 90 days the divorce is still final you need to either seek a lawyers opionion or go to the library and do some research on the laws in you state good luck i have been there and it sucks because all you want to do is move on with you life and they wont let you how wrong is that.
